Azia.pl Website and AziaRestaurants mobile Application Privacy Policy
The azia.pl Website through our AziaRestaurants mobile application aims at ensuring a high level of protection of our Users’ privacy. The following Privacy Policy sets the basic principles of gathering, processing and using information about the Users and the usage of files.
The terms used in this Privacy Policy shall have the following meaning:
─ Personal data – any information relating to an identified or identifiable natural person (e.g. name and surname, e-mail address);
─ Service Provider or equivalently we – „Azia Concept Sp. z o. o.” based in Warsaw at: al. Jana Pawła II 82 unit 1.05, 00-175 Warsaw, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the city of Warsaw in Warsaw, XIII Commercial Division of the National Court Register under KRS number: 0000633403, tax number NIP: 1132916587
─ Website – azia.pl website available at the following URL: https://www.azia.pl/;
─ Application – AziaRestaurants application for mobile devices known as “AziaRestaurants” available for free of chargé download at AppStore and Google Play digital distribution service;
─ User – a natural person who has an Azia Restaurants Account, as well as a person without such an Account who browses the Website or uses the services supplied electronically via the Website or the Application.
Personal Data
The Service Provider shall act as the Administrator of the personal data gathered and processed as a part of the Service and the Application.
The User who only visits and browses the Website does not need to inform us about their identity or provide their personal data. Collecting the personal data on the Website may occur when the User uses electronically supplied services through the Website or the Application (e.g. to register an Azia Restaurants Account or while providing the data necessary for fulfilment of Orders). The Website might as well automatically collect and process Users’ performance data, such as IP addresses, subject to the principles set out in the Act on Providing Services by Electronic Means.
In connection with registration (opening an account on the Website or in the Application) a User may also give voluntary consent to processing his or her personal data for the marketing purposes of the Service Provider, their subcontractors, and entities belonging to the Azia Concept capital group, as well as to receiving marketing information from the Service Provider, including offers and promotions referring to the Organiser, at the electronic mail address and the phone number provided by the User. Such consent is voluntary and the use of the services rendered via the Website or the Application is not subject to it.
The Application stores the following personal data of a User: e-mail address, sex, first name, surname, address, date of birth and the telephone number. With the User’s consent, the Application stores information on the location of the mobile device on which the Application was launched. Depending on the mobile platform, the Application may gain access to the following authorizations on the device:
– the Application may use data referring to the location provided by API (application program interface) of the mobile device in order to localize the device on the Azia Restaurants map and use additional functions of the map (filters, measuring the distance to the nearest restaurant). The device localization function may be turned off by the user at any time in the system settings; yet, this may have impact on other functions of the Application, e.g. ordering products with delivery.
– Privacy policy call making functionalities (in order to call the Issuer’s info line).
Depending on the mobile platform, the authorizations of the Application may be revoked when the system settings on the device are changed or the Application is uninstalled.
In case of using Dotpay online payment option the personal data of a User (first name, surname and email address) will be provided to „Dotpay” Sp. z o. o. with its registered office in Krakowie (ul. Wielicka 72, 30-552 Kraków) in order to process the payment.
We employ appropriate security means which are in accordance with the state of the art technology. They aim at ensuring that the Users’ personal data is effectively protected against its processing, collection, modification and unauthorised use. In case of providing personal information the connections with the Website are encrypted and protected from the third parties’ access by secure https certificates.
Communication between the Application and the Service Provider’s systems is carried out with the use of the SSL (Secure Socket Layer) protocol and additional encryption engines.
The use of the Website, the Application and the services it delivers does not expose the User to any specific danger that goes beyond typical risks associated with the use of the Internet. However, we recommend caution and using the software (antivirus programme, firewall) which protects against malware, identity theft and other dangers of the Internet.
The personal data deleted from the Application by the User may be still processed by the Service Provider, even when the Application is uninstalled, if the User still uses the account in the Service Provider’s system for remote order placing (this may occur, for instance, when orders are placed in Azia Restaurants via the Website www.azia.pl).
Cookies
The Website uses cookies. Cookies are IT data, especially text files which are stored in the device of the Web Site’s User (for example in computer memory). Cookies are usually stored at entering or leaving the Website. They are not used for establishing the identity of individual Users and they do not influence the performance of the User’s device. Depending on their type, those files are deleted as the browser session ends (so called session cookies) or after a longer period (so called persistent cookies).
Cookies are used for:
─ optimisation of the display of our Website on the User’s device;
─ identification of the User during the current session on the Website (so a logged-in User does not have to log again to every subpage of the Website); identification occurs on the basis of the ‘hash’ assigned to the User which contains no personal information;
─ statistical purposes;
─ confirmation that notification about the usage of cookies by this Website was displayed to the User (so it would not be displayed again until the cookies are deleted);
We also use Google Analytics provided by Google Inc. with its registered office at: 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. In every subpage of the Website there is a tracking code embedded which triggers a calling of Google servers (Google Analytics Tracking Code). Google Analytics reads and stores cookies in order to collect data about visits on the Website and the Users’ activities. On that basis, the following User’s data is collected: anonymous geographic location of the device, Internet access services providers, operation system, web browser, time and duration of the visit, sites visited and possible revisit on the website. The data provided by Google Analytics is not associated with any data referring to traffic or User’s data derived from other sources. Users can specify the conditions of storing and accessing cookies by using appropriate settings of their Internet browser. The default settings of most web browsers usually accept the cookies. However, a User can completely disable the cookies or adjust his or her browser to provide a notification whenever a cookie is sent. In order to prevent the reception of cookies or adjusting the settings the User should change the browser’s settings.
